Protecting fish in the Delaware River
On March 12, 2004, we requested a public hearing ( 19.45 Kb) on FPL Energy Marcus
Hook L.P.'s
permit application to allow it to remove 11 million gallons per day
of water from the
Delaware River using an existing intake located at the Sunoco Refinery
north of
Claymont. The hearing request describes why changes in the design of
the water intake
structure are needed to protect fish and wildlife.
Sunoco asked for approval to withdraw over 40 million gallons per day
from the same
water intake. On March 18, 2004, we filed a similar request for a public hearing ( 23.64 Kb) on
Sunoco's application.
In response to our request, DNREC held a public hearing on both permits
on May 12,
2004. At this hearing, we argued that Delaware regulations required
screening devices for FPL and Sunoco's intake structures. DNREC, however,
rejected these arguments and decided that the presence of screening
devices to protect fish was not a relevant issue for the permit.
