Comments
to Halt the Delaware Deepening
The Center represents Sierra Club, Delaware Audubon Society, Delaware
Nature Society, New Jersey Environmental Federation, National Wildlife
Federation, and DRKN in their efforts to stop the Army Corps of Engineer's
("Corps") proposal to deepen the main channel of the Delaware
River. In particular, the Center successfully petitioned the State of
Delaware to require the Corps to obtain a "subaqueous lands"
permit that requires a cost/benefit analysis for the project. During a
December 2001 hearing, the Center submitted comprehensive written and
oral comments regarding the legal sufficiency of the Corps' subaqueous
lands permit application.

On March 18, 2002, the Center submitted a reply to the Corps' response

On April 22, 2002, the Corps suspended work on its plan to dredge the
Delaware River, pending a reanalysis of the project's costs and benefits.
