Center Wins Appeal, Permit to Discharge Mining Waste in Lehigh Valley Revoked
On behalf of the East Penn Concerned Citizens (“EPCC”), MAELC intervened to challenge Pennsylvania’s
issuance of NPDES permit to an asphalt mine. The NDPES permit would
allow discharge to an Exceptional Value (“EV”) water, the Unnamed
Tributary to Lizard Creek. EV waters are those waters that are supposed
to receive special protection by the State. A hearing before the
Environmental Hearing Board transpired in the Spring of 2004 followed
by post-hearing briefing. Briefing was concluded in August. In November
2004, the Environmental Hearing Board ruled in favor of EPCC and
revoked the NPDES permit.
