Request for Public Hearing on DE Solid Waste Authority
for gas flare at Cherry Island Landfill in Wilmington, DE
On July 14, 2003, on behalf of the Clean Air Council, the Center requested ( 21.71 Kb) that DNREC hold a public hearing on the Delaware Solid Waste Authority's
request for a permit for a landfill gas flare at the Cherry Island landfill
in Wilmington, Delaware. According to a public notice for the proposed
permit, the flare has the potential to release several pollutants into
the air. EPA has found that landfill gasses contribute to ozone formation,
cause odors and may cause health problems. The request seeks more information
on the proposed flare to allow the public to have a meaningful role in
the permit process.
A public hearing was held on October 23, 2003 and the Center suggested
several ways the permit could be improved to protect the environment.
In February 2004, DNREC issued the final permit for these flares. The
permit incorporates several additional requirements as a result of
our comments. Notably, the permit will require enhanced odor monitoring,
preparation of a written startup, shutdown and malfunction plan and
inclusion of these requirements in the renewal of the landfill's Title
V permit.
